Terms of Service

1. Agreement to Terms

By accessing or using Journivo ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 13 years of age and have the legal capacity to enter into these Terms.

2. Account Terms

2.1 Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account

2.2 Account Security

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

2.3 Account Sharing

Your account is personal to you and may not be shared with others. You may not transfer or assign your account to any third party without our prior written consent.

3. Service Description

Journivo is a travel budget planning and expense tracking application that allows you to:

  • Create and manage travel plans with budgets
  • Track expenses in multiple currencies
  • Split expenses with travel companions
  • Plan itineraries with stops and activities
  • Track flights and transportation
  • Save points of interest on maps
  • Access your data offline

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

4. Subscription Terms

4.1 Free Tier

Our free tier includes:

  • 1 active travel plan
  • 2 currencies
  • Unlimited expenses and itinerary items
  • Expense splitting
  • Offline access

4.2 Premium Tier

Our premium subscription includes:

  • Unlimited travel plans
  • Unlimited currencies
  • Flight budget tracking with safety margins
  • All free tier features
  • Priority support

4.3 Billing

Premium subscriptions are billed monthly or annually through our payment processor (Stripe, via Clerk). By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • Your subscription will remain active until the end of the current billing period
  • You will not be charged for subsequent billing periods
  • Your account will revert to the free tier
  • Data exceeding free tier limits will remain accessible but not editable until within limits

4.5 Refunds

Subscription fees are generally non-refundable. However, we may provide refunds at our discretion for exceptional circumstances. Contact us at support@journivo.com for refund requests.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Transmit malware, viruses, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Service
  • Collect or harvest user data without authorization
  • Use automated systems to access the Service without permission
  • Impersonate others or misrepresent your affiliation
  • Share content that is illegal, harmful, or offensive
  • Use the Service for money laundering or other financial crimes

We reserve the right to suspend or terminate your account for violations of these acceptable use terms.

6. User Content

6.1 Ownership

You retain ownership of all content you create, upload, or share through the Service ("User Content"), including trip plans, expenses, itineraries, and other data.

6.2 License to Journivo

By using the Service, you grant us a limited license to use, store, process, and display your User Content solely for the purpose of providing and improving the Service. This license is:

  • Non-exclusive and royalty-free
  • Limited to providing and improving the Service
  • Terminated when you delete your content or account

6.3 Shared Content

When you share a trip with other users, you grant them permission to view and interact with the shared content according to the permissions you set. You are responsible for the content you share and who you share it with.

7. Third-Party Services

Our Service integrates with third-party services to provide functionality. By using our Service, you acknowledge that:

7.1 Google Maps

Location features are powered by Google Maps. Your use of mapping features is subject to Google's Terms of Service and Privacy Policy.

7.2 Clerk (Authentication)

Account authentication is provided by Clerk. Your authentication data is subject to Clerk's Terms of Service and Privacy Policy.

7.3 Stripe (Payments)

Payment processing is handled by Stripe through Clerk. Your payment information is subject to Stripe's Terms of Service and Privacy Policy.

8. Disclaimers

8.1 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 Currency Exchange Rates

Currency exchange rates displayed in the Service are for informational purposes only and may not reflect real-time market rates. Actual exchange rates at the time of transactions may differ. We do not guarantee the accuracy of exchange rate data.

8.3 Not Financial Advice

Journivo is a budgeting tool and does not provide financial, tax, or investment advice. You should not rely on the Service as your sole source of financial planning. Consult with qualified professionals for financial advice.

8.4 Travel Planning

We do not guarantee the accuracy of any travel-related information. Flight times, prices, and availability shown in the Service may change. You are responsible for verifying all travel arrangements with official sources and service providers.

8.5 Data Loss

While we take measures to protect your data, we cannot guarantee against data loss. You are encouraged to maintain your own backups of important information.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOURNIVO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Business interruption
  • Cost of substitute services
  • Any other intangible losses

ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us, if any, during the twelve (12) months prior to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Journivo and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your User Content

11. Termination

11.1 Termination by You

You may terminate your account at any time through your account settings. Upon termination, your right to use the Service will immediately cease.

11.2 Termination by Us

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include:

  • Violation of these Terms
  • Suspected fraudulent or illegal activity
  • Extended periods of inactivity
  • Discontinuation of the Service

11.3 Effect of Termination

Upon termination:

  • All licenses granted to you under these Terms will terminate
  • You must cease all use of the Service
  • We may delete your account and User Content
  • Sections that by their nature should survive will remain in effect

12. Governing Law and Disputes

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.

12.2 Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Journivo regarding the Service.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

13.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
